Required advertising warning

Minn. Stat. § 342.64, subd. 1(7) requires every advertisement for a cannabis business or cannabis product to carry a warning specified by the Office of Cannabis Management. OCM sets that exact wording in Guidance Memo GM-2025-07. The current cannabis-business warning, which appears in the footer of every page on this site, reads in full:

Warning: Cannabis products are not for use by anyone under the age of 21. Cannabis use may cause drowsiness, affect focus, reaction time, and decision-making. These products are not evaluated or approved by the FDA. Pregnant people should avoid cannabis due to the risk of low birth weight, premature birth, stillbirth, and harm to fetal brain development.

This wording is set by OCM and is reproduced verbatim. It is not a paraphrase, and it must not be shortened or reworded in any advertisement.

Warnings on product packaging

Licensed manufacturers and producers are responsible for compliant product packaging and labeling. Levitated only offers regulated products that are required to meet applicable Minnesota packaging and labeling requirements, including Minn. R. 9810.1400. Each label carries the following warning statement, in no smaller than size 6 font:

Keep this product out of reach of children. This product may be unlawful outside the state of Minnesota.

Compliant labels also display the Minnesota universal THC symbol, the standard warning symbol, the batch number from the statewide monitoring system, and potency and serving information. If you ever receive a product from us without these, please bring it back and tell us.

Cannabis affects people differently and the effects of edible products can be delayed. Start with a low dose, wait before taking more, and store everything out of reach of children and pets. Our Responsible Use and Dosing Guide pages go into more detail.

Minnesota transaction limits

Minn. Stat. § 342.27, subd. 2(c) caps what one customer may purchase in a single transaction:

A note on the 800 mg figure. Edible cannabis products and lower-potency hemp edibles share a single combined 800 mg cap — they are not counted separately, and lower-potency hemp edibles do not carry a separate 50 mg per-transaction limit. The 5 mg and 50 mg figures often quoted refer to how an individual product is formulated, not to how much you may buy at once.

Separate limits govern how products themselves are made:

  • Edible cannabis products intended to be eaten: no more than 10 mg THC per serving, and no more than 200 mg THC per package, with each serving marked by scoring, wrapping, or another indicator.
  • Edible cannabis products intended to be consumed as beverages: no more than 10 mg THC per serving, and no more than two servings per container.
  • Lower-potency hemp edibles: no more than 5 mg delta-9 THC per serving, or for beverages, no more than 10 mg delta-9 THC per container.

We verify age before every sale, as required by Minn. Stat. § 342.27, subd. 4, and we will decline a transaction that would exceed any of these limits.

Advertising compliance statement

This website and our marketing are built to meet Minn. Stat. § 342.64. Specifically:

  • We carry the OCM-specified warning on every page of this site.
  • We make no false or misleading statements, and no unverified claims about health or therapeutic benefits.
  • We do not promote overconsumption.
  • We do not depict anyone under 21 consuming cannabis, and we use no cartoons, toys, animals, children, or other imagery designed or likely to appeal to people under 21.
  • We do not use images of alcohol or of people consuming alcohol.
  • We do not advertise in any medium where 30 percent or more of the audience is reasonably expected to be under 21, based on current audience composition data.
  • We do not use unsolicited pop-up advertising.
  • Before any direct, individualized communication — our email newsletter — we require age affirmation, so every subscriber confirms they are 21 or older at signup, as permitted under subd. 5. Every message carries a one-click unsubscribe. We do not currently send SMS or text-message marketing.
  • We do not target advertising to location-based devices.
  • This site is age-gated, and outdoor advertising is limited to signage on our own building, as allowed under subd. 2.

No medical claims

Statements on this website have not been evaluated by the U.S. Food and Drug Administration. Cannabis products sold at Levitated Dispensaries are not intended to diagnose, treat, cure, or prevent any disease or medical condition. This is an adult-use retail establishment, not a medical provider, and our staff are not medical professionals. Consult a licensed healthcare provider before using cannabis, particularly if you are pregnant or breastfeeding, take prescription medication, or have a health condition.
